This page (together with the documents referred to on it) tells you the terms and conditions on which you may purchase our products on/make use of our website www.freshimpactdesigns.co.uk. By using our sites, you indicate that you accept these terms and conditions and that you agree to abide by them at all time. If you do not agree to these terms and conditions, please refrain from using our site.

Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

We process information about you in accordance with our privacy policy. By using our sites, you consent to such processing and you warrant that all data provided by you is accurate and complete.

Information about us and our product

Fresh Impact Design (“we”, “us” or “our”) is an online gift store and operates the websites www.freshimpactdesigns.co.uk. We are a small business registered in England and Wales and have our office at 26 Broomfield Road Reading RG30 6AL. The majority of our products are handmade and therefore subject to some imperfection. The prices displayed on our site are quoted in British pounds.

Access

We reserve the right to withdraw or amend the products and services we provide on our site without notice. We will not be liable if for any reason our site are unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms and conditions and that they comply with them at all time.

Members area

If you are provided with a user identification code, password or any other piece of information for the purposes of accessing our members area, you must treat such information as confidential and you must not disclose it to any third party. We reserve the right to disable any user identification code or password at any time if we consider that you have failed to comply with any of these terms and conditions. If you know or suspect that any third party knows your user identification code or password, you must promptly notify us by email to freshimpactdesigns@gmail.com.

Limitations of liability

We aim to provide the best product we can and to specify clear guideline on how to use them. The product displayed on our sites is provided on an “as is” “as available” basis without any guarantees, conditions or warranties that they always be safe, secure, or that they function without imperfection. Subject to the full extent permitted by law, we also DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We cannot predict when issues may arise with our product. Therefore, our liability should be limited to the fullest extent permitted by applicable law, and under no circumstances will we be liable to you for any lost of profits, revenues (directly or indirectly) or consequential loss or damage incurred by any user in connection with our product and site or in connection with the use, inability to use, or results of the use of our product and site. Nothing in these terms of use shall limit or exclude our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Intellectual property rights

Except where indicated otherwise, we are the owner or the licensee of all intellectual property rights on our site, and in the products created for it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. Contents of the members area may be confidential, commercially sensitive and/or subject to legal privilege. You should ensure that no one (inside or outside your organisation) gains access to such information unless they have all necessary authorizations to do so. If any unauthorized person gains access to our members area or information from it, this may lead to a loss of legal privilege or of the confidential nature of such information, or to their disclosure to unauthorized persons.

You must not modify any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not use any part of the materials on our site for commercial purposes without obtaining a license to do so from us. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Pricing and payment terms, including shipping, returns, exchanges and cancellations

Prices of Goods are shown on our website. It is possible that the price may have increased from that posted on our website. If that happens, we will not dispatch the product.

Price include VAT but exclude delivery costs, which will be automatically add to the total amount due when you view the items in your shopping basket and have selected your chosen delivery method.

Prices and delivery costs are liable to change at any time, but changes will not affect orders which have Dispatch Confirmation.

Our site contains a large number of our products and it is always possible that, despite our best effort, some of our products listed on the site may be incorrectly priced. We normally verify our prices as part of our dispatch procedures so that, where our product's correct price is less than our stated price, we will charge you the lower amount. If our product's correct price is higher than the stated price on our site, we will normally, at our discretion, either contact you for instruction before dispatching our product, or reject your order and notify you of such rejection.

Payment for any order must be made by Paypal, credit card or debit card on the check out page. We accept payments by most major credit and debit cards.

You should be aware that online payment transactions are subject to validation checks by the card issuer and we are not responsible if your card issuer declines to authorize payment for any reason. Please note, it is possible that your card issuer may charge you an online handling or processing fee. We are not responsible for this.

Subscription Auto-Renewals

In order to ensure that you do not experience any interruption or loss of services, certain Subscription Services include an automatic renewal option by default, according to which, unless you turn-off the auto-renewal option, such Paid Services will automatically renew upon the end of the applicable subscription period, for a renewal period equal in time to the original subscription period (excluding extended periods) and, unless otherwise notified to you, at the same price (subject to applicable Taxes changes and excluding any discount or other promotional offer provided for the first period).

By purchasing a Subscription Service, you acknowledge and agree that the Subscription Service shall automatically renew in accordance with the above terms.

You may turn-off the auto-renewal option for Subscription Service at any time via your User Account.

Cancellation, refunds and returns

We offer a full money-back (exclude postage) guarantee for all purchase, except for jewellery products due to hygiene reason. In order to be eligible for a refund, you have to return the product within 14 calendar days of your purchase. The product must be in the same condition that you receive it and undamaged in any way.

After receiving the return product, it will be inspected and your refund will be process accordingly. The money will be refunded to the original payment method you've used during your purchase.

If the product is damaged in anyway or 14-day period has passed, you will no longer eligible for a refund.

Cancellation of subscription service much be made before the renewal date, in order for us to stop sending out our product to you.

Complaints handling process

We pride ourselves on our quality of product and service to our customers. If, however, there is any aspect of our product or service with which you are not happy (including our invoice), please speak to the person with overall responsibility for your matter and/or with Trina Pham. If for any reason we are unable to resolve the complaint or you are not satisfied with our handling of it, you may be entitled to ask the Legal Ombudsman (whose contact details are available at www.legalombudsman.org.uk) to consider the complaint.

Variations

We may revise these terms and conditions at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you.

Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site and/or members area.

General

If any part, term or provision of these terms and conditions is held to be illegal, invalid or otherwise unenforceable, the validity or enforceability of the remainder of these terms and conditions shall not be affected. Any failure or delay on our part to exercise or enforce any right in these terms and conditions does not waive our right to enforce such right.

Notwithstanding anything to the contrary contained in these terms and conditions, they shall not operate to confer any rights or benefits on any third parties other than our business.

Nothing in these terms of use shall create, or be deemed to create a partnership or the relationship of principal and agent between us and you.
